Terms of Conditions 

Blue Nile Livery LLC (“BNL”) is a licensed livery service in the Commonwealth of Massachusetts. By using BNL’s website, bluenilelivery.com and by requesting, purchasing, or booking service through BNL’s website, the user and customer (“Client”) agrees to and are hereby bound by the following terms of service (“TS”), website acceptable use policy (“AUP”), and privacy policy (“PP”) available at WEB ADDRESS OF PP. Rates, Fees, and Surcharges.

BASE FARES

A fuel charge of 7% applied to base fare on all services. When being invoiced hourly, the hourly rate is tracked from the time the vehicle leaves the BNL facility until the time it returns to the BNL facility, with a two (2) hour minimum on weekdays and a three (3) hour minimum on the weekends. Fractions of an hour are rounded up to next half-hour. Unless otherwise agreed to in writing by BNL, all deposits are non-refundable. All stop time & wait time will be itemized on the invoice statement.

GRATUITY

A twenty (20%) percent gratuity for the chauffeur is automatically added to the base fare.

WAIT TIME

For all point-to-point reservations, wait time will be charged at seven ($7.00) dollars per five (5) minutes increment once the grace period has elapsed. A grace period is defined as seven (7) minutes beyond the scheduled pick up time for point to point service. For an airport reservation, a thirty (30) minute grace period is allowed following the reported domestic flight time of arrival. A sixty (60) minute grace period is allowed following the reported international flight time. Bus schedules cannot be monitored therefore, time tracking begins at the scheduled pick up time.

LIMOUSINES OR BUSES

For Clients requesting limousines or buses, the following out-of-pocket   charges will be itemized on the invoice statement: -Two-Way Tolls -Parking -Airport Fees -Other out-of-pocket charges may include cell phone usage

AIRPORT SURCHARGE

BNL provides an airport greeter service available for gate greets at Logan International Airport for a fee of forty-five ($45.00) dollars. If Client requires a sedan or sports utility vehicle pick from the airport between the hours of 12:00 a.m. and 3:00 a.m., there is a surcharge of twenty-five ($25.00) dollars.

CANCELLATION

All reservations and cancellations must be confirmed by BNL. The Cancellation Fee (“CF”) will be the full fare plus a twenty (20%) percent gratuity, as well as any additional costs or surcharges already incurred by BNL in anticipation of the scheduled pick up. A CF will apply for any reservation that is not canceled at least three (3) hours prior to the scheduled pickup time, except for international reservations must be canceled twenty-four (24) hours in advance to avoid a CF.

REFERRAL FEES

In the event BNL is unable to provide one of its employee drivers for your ride, BNL may contract with a qualified affiliated company to provide the service. If you have any questions regarding this policy, please contact BNL.

BILLING

Invoices are billed to the customer’s credit card attached to their account and as indicated by booking a reservation. BNL will bill the Client upon completion of the requested booking, or upon a cancellation in accordance with the above cancellation policy. BNL accepts the following major credit – American Express – Discover Card – MasterCard – Visa

NO-SHOW FEES

A no-show fee shall be equal to the anticipated trip, plus any applicable service fees, plus applicable wait time, plus a twenty (20%) percent gratuity. The client will be charged when the passenger fails to show at the designated location for any reason. If you cannot locate your driver, call 617-953-6203 to avoid a no-show fee.

HOLIDAYS

BNL charges a thirty-five ($35.00) dollar holiday surcharge on all trips occurring on New Year’s Day – Presidents Day – Easter Sunday – Memorial Day – Fourth of July – Labor Day – Thanksgiving Day – Christmas Day

ADDITIONAL TERMS

Events Services (Limousines, Vans, Minibuses, Motor-coaches, and/or Black Cars). All Event Services vehicle types will be billed at the prevailing BNL hourly rate. Clients are billed from the time personnel and/or vehicles leave the BNL facility until the time it returns to the BNL facility. All Reservations that are billed on an hourly basis and Clients will be billed a minimum of thirty (30) minutes travel time each way plus the time the passenger(s) are in the vehicle. Fractions of an hour are rounded to next half-hour.

DAMAGE TO VEHICLE

The Client shall be responsible and liable to BNL for any damage caused to a limousine or other property of BNL or any other party used by BNL caused by the Client or any member of the Client’s party in the course of using services provided by or through BNL. In addition to the fee or fees set forth above, the Client shall pay BNL one hundred dollars ($100.00) for each carpet or seat burn and two hundred and fifty dollars ($250.00) for any additional damage or cleaning of vehicles required due to Client’s use, or a member of Client’s party use, unless the damage or expenses exceed two hundred and fifty dollars ($250.00), in which case the Client shall be responsible for all cleaning and/or repairs required.

BEST EFFORTS AND LIMIT OF LIABILITY

BNL will use its best efforts, in good faith, to provide services as requested, but BNL shall not be responsible or liable for any failure or delay in providing services that may result from weather conditions, road conditions, vehicle and other breakdowns, delays or destruction caused by public carriers or other circumstances or conditions reasonably beyond the anticipation or control of BNL. BNL will notify its Client as promptly as possible of any difficulty encountered or anticipated in providing the requested services. The Client agrees that BNL will have no responsibility or liability for lost or damaged baggage, personal belongings, or any items left in a vehicle or on the premises of BNL or any affiliate.

CLIENT BEHAVIOR

All drivers have the right to prohibit smoking, alcohol consumption, and/or other inappropriate conduct; and any driver may terminate a specific trip or other services for failure by the Client or any member of the Client’s party to respond to reasonable requests by the driver.

WEBSITE ACCEPTABLE USE POLICY

Hacking, Viruses, & Network Attacks: Do not access any computer or communications system without authorization, including the computers used to provide the BNL website. Do not attempt to penetrate or disable any security system. Do not intentionally distribute a computer virus, launch a denial of service attack, or in any other way attempt to interfere with the functioning of any computer, communications system, or website. Do not attempt to access or otherwise interfere with the accounts of other users of the Service.   Spam: Do not send bulk unsolicited e-mails (“Spam”) or sell or market any product or service advertised by or connected with Spam. Do not facilitate or cooperate in the dissemination of Spam in any way. Do not violate the CAN-Spam Act of 2003.   Intellectual Property: Do not infringe upon the copyrights, trademark rights, trade secret rights, or other intellectual property rights of BNL. All rights reserved.Violation of this Acceptable Use Policy (this “AUP”) may lead to suspension or termination of the Client’s account and/or legal action. In addition, the Client may be required to pay for the costs of investigation and remedial action related to AUP violations. BNL reserves the right to take any other remedial action it sees fit.

TERMS OF SERVICE & ACCEPTABLE USE POLICY– SUBJECT TO CHANGE

BNL may change this Terms of Service or AUP at any time by posting a new version on this page or on a successor page. The new version will become effective on the date it’s posted, which will be listed at the top of the page. Please check this page periodically for changes. By your continued use of our services and our site following the posting of changes to these terms, you will be deemed to have accepted this policy and any such changes. Any reservation made prior to the time any change is posted will be completed according to the policies and rates that applied at the time of booking.
